Sources of Obligation

Following are the sources of obligation:

1. Law. An obligation arises from law when the law itself provides for it such as those provided for by the New Civil Code and other special laws. Examples include the obligation to support one’s family and the obligation to pay taxes.

2. Contracts. An obligation may arise from the stipulation of the contracting parties.

3. Quasi-Contracts. These are juridical relations arising from lawful, voluntary and unilateral acts, by virtue of which the parties become bound, based on the principle that no one shall be unjustly benefited at the expense of another. An example is the obligation to return payment which is paid by mistake or one which is not due.

4. Delicts. These are crimes or acts or ommissions punishable by law. Obligation here arises from the civil liability as a consequence of a crminal offence based on the principle cited in the Revised Penal Code that every person criminally liable for a felony is also civilly liable, except for certain offenses, such as rebellion treason and gambling.

5. Quasi-delicts. These are acts or ommissions by a person causing damage to another, giving rise to an obligation to pay for the damage done, there being fault or negligence but no pre-existing contractual relation between the parties.
